Terms of Service — ProQ Snapshot

These Terms of Service ("Terms") govern your access to and use of the ProQ™ Progressive Intelligence Snapshot and related content at proqsnapshot.com (the "Service"), operated by ProQ Systems ("ProQ", "we", "us", or "our"). By using the Service, you agree to these Terms.

1. Use of the Service

You may use the Service for lawful business and personal development purposes. You agree not to misuse the Service, attempt to disrupt it, reverse-engineer it, or use it to violate any law or the rights of others.

2. Assessment Results

ProQ Snapshot results, scores, and recommendations are provided for informational and educational purposes only. They are not professional, legal, financial, medical, or psychological advice and should not be relied upon as a substitute for qualified advice tailored to your situation.

3. Accounts and Information

You agree to provide accurate information when completing the Snapshot. You are responsible for the information you submit and for the security of any account credentials used to access additional ProQ services.

4. Intellectual Property

The Service, including the ProQ™ name, the Progressive Intelligence framework, assessment questions, scoring methodology, design, and content, is owned by ProQ Systems and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our written permission. Your individual results report is for your personal and internal business use.

5. Email Communications

By submitting your email you consent to receive your results and related communications from ProQ. You can unsubscribe from marketing emails at any time using the link in the footer of those emails. Transactional emails (such as results delivery) may continue while you use the Service.

6. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that the results will meet your expectations.

7. Limitation of Liability

To the maximum extent permitted by law, ProQ Systems and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Service. Our aggregate liability for any claim relating to the Service is limited to the greater of USD $100 or the amount you paid us in the twelve months preceding the claim.

8. Termination

We may suspend or terminate your access to the Service at any time if you breach these Terms or use the Service in a way that could cause harm to ProQ or other users.

9. Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of the United States and the state in which ProQ Systems is established, without regard to its conflict-of-law rules.
